Music Exec Joey Averback Dies at 59

Music industry executive Joey Averback died March 18 at his home in Studio City after a two-year battle with oral cancer. He was 59.

Averback, the son of the late actor and TV director Hy Averback, was vp sales and marketing at Westwind Media in Burbank, where he began 12 years ago as an executive liaison for soundtracks on such films as Hope Floats and Selena.

Averback began his career producing music and developing artists with composer Mike Post and then worked in A&R for Jobete Music and Elektra.

Survivors include wife Suzanne Benedict, son Evan, brother Marc and sister Amy.

Review: Canon PowerShot S95: Travel-Friendly Advanced Point-and-Shoot
The PowerShot S95 is a perfect camera to grow with, thanks to its pocketable size and ultimate blend of automated and manual controls.
The PowerShot S95 a small, most pocket-friendly camera that doesn’t sacrifice performance to achieve its dimensions. The S95 ($400 as of January 3, 2011) is a minor upgrade to last year’s highly rated Canon PowerShot S90 (it adds 720p high-definition video capture at 24 frames per second and an HDR scene mode to the S90′s array of offerings), and in many respects it’s a tiny, pocketable version of the Canon PowerShot G12. It offers most of that camera’s fun shooting modes, and its image and video quality are impressive for its size. It’s also noteworthy among the five models we tested for being the most accessible to casual shooters.

‘John Wall Dance’ Rapper Sues CBS Over College Basketball Coverage

What’s the definition of “March Madness”? For most, it’s the annual NCAA Men’s Basketball tournament where 68 teams will compete for championship glory. In the legal sphere, it may be a lawsuit filed against CBS Broadcasting on Friday by a Kentucky rapper who believes the network’s college basketball coverage unfairly took advantage of a national dance craze he helped spark.

The Cinderella in this lawsuit is Kensey “Kenzo” Rankin, a hip hop artist who created the song, ”Do the Shizz.” He owns the copyright to the song along with Gracie Prods and another man, Marcus Clark. Together, they allege that CBS has been exploiting the song without permission.

The song came to prominence last year thanks to basketball phenom John Wall, who starred last season as a point guard for Kentucky University before being drafted first overall by the Washington Wizards. Wall came to Kentucky with a lot of hype, and when he was introduced in 2009 to the adulating masses of Wildcat nation at Big Blue Madness, he did it in style.

Amid theatrics that would make producers of “Spider-Man: Turn off the Dark” blush, Wall entered the stadium from the rafters and with “Do the Shizz” playing, he made a crazy yet simple fist dance move that lasted approximately four seconds. It was enough to spark a viral sensation.

Soon, basketball fans, people getting married, kids, librarians, and others were doing the “John Wall Dance” and posting their imitations on YouTube. The madness got even more crazy after ESPN covered the phenomenon.  (See below)

Everyone’s dancing this tournament season except for Kenzo, who is looking for a piece of the action.

Kenzo has filed a lawsuit against CBS for airing several segments about Wall and the dance. He’s not claiming copyright in the dance — although, choreography has been known to be copyrighted — but rather that his music has been exploited. It’s unclear whether the network cued up the track or just had the song playing as incidental background music. Nevertheless, Kenzo is seeking maximum statutory damages of $150,000 per infringement and an injunction that would prevent it from using the song in the future without authorization.

Charlie Sheen, Brooke Mueller Reach Custody Agreement

NEW YORK – Laywers for Charlie Sheen and estranged wife Brooke Mueller said they have struck an agreement that settles a custody dispute over their twin sons and will end her pursuit of a restraining order, the Associated Press reported.
The news came as the Los Angeles Police Department conducted a search Thursday night at Sheen’s home to check if he was in possession of weapons, which would violate a restraining order taken out last week by Mueller.
In a statement, attorneys for Sheen and Mueller said the former couple had “reached an agreement that resolves their differences.” Details of the arrangement were kept confidential.
Mueller obtained a temporary restraining order, claiming Sheen threatened her on a recent trip to the Bahamas. A hearing on the issue was previously scheduled for March 22.
